ChexSystems, a company
which gives banks your personal information, has far too
much power. They have the power to prevent your opening
of accounts at 80% of financial institutions in America.
They are designed to protect banks against fraud, which
is a valid purpose when used correctly. |
The problem is that if
you make one small error in bookkeeping, causing you to
write a bad check, or if the bank makes such an error,
then the bank has grounds to put you on the ChexSystems
database. Even one
negative mark on this database can keep you from being
able to open a new account for up to five
years. Do we deserve such a harsh
punishment for one mistake? Even if you pay the bank,
your report may stay on the database. The ChexSystems
website FAQ says, "A reporting member [bank] is
under no obligation to remove an accurate report of
account mishandling due to payment of monies owed.
However, if a collection amount is reported, the member
is obligated to mark the account as paid." We need
to persuade the Federal Government to form some more
guidelines regarding what kind of, and how many offenses
make it right for banks be allowed to post our
information. ChexSystems has a good idea on paper, but their system is not regulated by the Government, and it is being greatly misused. Don't become a victim. Read the petition for more information. |

If you feel you have been violated, used, or otherwise unfairly treated by ChexSystems, you can contact your state attorney general. The sites can be easily found using a search engine. For instance, in Infoseek, use the search string "Attorney-General AND [statename]" (no quotes), where statename is the name of the state of your residence. E-mail me at: |
